Legal status of governing councils
Every council with an approved constitution is an incorporated body. Your site’s approved constitution is evidence of the council's legal status as an incorporated body.
Civil liability protection
The Education and Children's Services Act 2019 has provisions for civil liability protection for members of:
- governing councils
- committees and affiliated committees.
This protection is only if people have behaved in good faith (behaved appropriately) while carrying out their duties as a member of the council/committee.
